APBCO Consult ("APBCO Consult", "we", "us" or "our") is a specialised advisory division providing personal protection solutions, including GAP Cover, Travel Insurance, Wills & Estates, Pet Insurance and Medical Aid. We are committed to protecting your privacy and handling your personal information in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA") and other applicable South African legislation.

By using this website or by providing us with your personal information, you acknowledge that you have read and understood this Privacy Policy.

1. Who is responsible for your information

APBCO Consult is the "responsible party" under POPIA, meaning we determine the purpose and means of processing your personal information.

2. Information we collect

• Insurance and financial details: information relating to the policies or quotes you request, bank account details for premium collection, and claims history.
• Special personal information: where necessary for the product you require, for example health information for Medical Aid or GAP Cover applications, or family and beneficiary details for Wills & Estates. We only process this where you consent or where the law permits.
• Pet information: details about your pet (such as breed, age and medical history) when you request Pet Insurance.
• Travel information: destinations, travel dates and traveller details when you request Travel Insurance.
• Technical information: IP address, browser type, device information, pages visited and how you interact with our website.
• Communications: records of your enquiries, emails, forms submitted and calls with our brokers.

3. How we collect your information

• Directly from you, when you complete a form, request a quote, contact us or become a client.
• From existing APBCO clients who have requested our advisory services.
• From insurers, underwriters and product providers in the course of administering your cover.
• Automatically, through cookies and similar technologies when you visit our website.

4. Why we use your information

We process your personal information only for lawful purposes, including:

• Providing professional advice and assisting you with quotes, applications and policies.
• Communicating with you about your enquiries, policies and claims.
• Meeting our legal and regulatory obligations, including those under financial services and anti-money-laundering legislation.
• Administering, managing and improving our services and website.
• Fraud prevention, risk assessment and record keeping.
• Sending you relevant information and offers, where you have consented or where the law allows (see Direct marketing below).

Our lawful grounds include your consent, the performance of a contract or steps taken at your request before entering into one, compliance with a legal obligation, and our or a third party's legitimate interests.

5. Who we share it with

We do not sell your personal information. We may share it with:

• Insurers, underwriters, administrators and product providers, in order to quote, issue and manage your cover.
• Other entities within the APBCO group, where needed to serve you.
• Service providers who support our business, such as IT, hosting, analytics, advertising and communication providers, who are required to protect your information.
• Regulators, law enforcement, courts and other authorities where required by law.
• Professional advisors such as auditors and legal advisors, under duties of confidentiality.

6. Cookies and tracking technologies

Our website uses cookies and similar technologies to make the site work, understand how it is used and measure the effectiveness of our marketing. These include:

• Google Tag Manager: manages the tags and scripts used on our website.
• Meta Pixel: helps us measure and improve our advertising on Facebook and Instagram.
• Contentsquare: provides anonymised analytics on how visitors navigate and use our pages so we can improve the user experience.

These third parties may collect information such as your IP address, device identifiers and browsing activity, and may process it outside South Africa. You can control or delete cookies through your browser settings; however, disabling some cookies may affect how the website works. You can also manage ad preferences through your Facebook and Google account settings.

7. How we protect your information

We take reasonable technical and organisational measures to protect your personal information against loss, damage, unauthorised access and unlawful processing. These measures include access controls, secure systems and confidentiality obligations for our staff and service providers. If a security compromise occurs that affects your information, we will notify you and the Information Regulator as required by POPIA.

No method of transmission over the internet is completely secure, and we cannot guarantee absolute security.

8. How long we keep your information

We keep your personal information only for as long as necessary to fulfil the purposes for which it was collected, or as required by law, regulation or contract (for example, record retention periods under financial services legislation). When it is no longer needed, we will securely delete or de-identify it.

9. Cross-border transfers

Some of our service providers (such as analytics and advertising platforms) may store or process information outside South Africa. Where this happens, we take steps to ensure that the recipient is subject to law, binding rules or agreements that provide an adequate level of protection, as required by POPIA.

10. Your rights

Under POPIA, you have the right to:

• Ask whether we hold personal information about you and request access to it.
• Request correction or deletion of information that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or unlawfully obtained.
• Object to the processing of your personal information on reasonable grounds.
• Withdraw your consent at any time, without affecting processing already done on the basis of that consent.
• Object to direct marketing and opt out at any time.
• Lodge a complaint with the Information Regulator.

11. Direct marketing

We may send you information about our products and services by email, SMS or telephone where you have given consent, or where you are an existing client and the communication relates to similar products. Every marketing message will include a way to opt out, and you can unsubscribe at any time by contacting us.

12. Children's information

Our website is not directed at children. We only process the personal information of a child (a person under 18) with the consent of a parent or legal guardian, or where the law otherwise permits, for example when a child is a dependant or beneficiary under a policy or estate plan.
